He discovered the charger through the EVgo app, which listed it as publicly available. However, the steep charges, which included a $5 per kWh fee plus an additional $5 for every minute connected, were not disclosed upfront, leaving Kpenkann with a bill he never anticipated for a roughly 40-minute charge.

This incident is not isolated. A similar case was reported in June, where Steve Birkett of Plug & Play EV encountered a Hyundai dealer in Union, New Jersey, charging an astounding $15 per kWh for his IONIQ 5. Beyond the excessive pricing, many dealerships were also found to restrict access to their charging ports, prioritizing their own inventory or service vehicles, or making them inaccessible outside of business hours. Some even placed signs actively discouraging public use despite listing their chargers as "public."

The core of this problem lies in the current regulatory landscape for EV charging stations, which often lacks the transparency requirements imposed on traditional gas stations. Unlike fuel pumps, which mandate clear and visible pricing from the street, many EV charge point operators (CPOs) are not obligated to display their rates prominently before a driver plugs in. This regulatory loophole allows unscrupulous CPOs, particularly some car dealerships, to take advantage of unsuspecting EV owners, especially those new to electric vehicles. The author argues that this situation is detrimental to the EV industry's growth and calls for more stringent regulations to protect consumers.

To rectify these issues and foster trust in the EV charging ecosystem, several key measures are proposed. Firstly, there needs to be a mandate for unfettered public access to charging stations, particularly those that receive public funding. This means ensuring chargers are available for public use for at least 16 hours a day, with dealership-related vehicle charging taking a secondary priority. Secondly, transparent pricing is crucial; CPOs should be required to display illuminated signs with clear per kWh rates, similar to gas stations. Thirdly, there should be a cap on energy markups to prevent price gouging, with frequent audits to ensure compliance. Lastly, an aggressive clawback mechanism is needed to reclaim incentive dollars from CPOs who fail to adhere to these standards, whether through utility bill adjustments, tax penalties, or other enforceable means. These measures aim to ensure that public charging programs genuinely serve the public good rather than solely benefiting CPOs.
